The Supreme Court (SC) of India has taken suo motu cognizance of fire safety norms in buildings and coaching institutes, particularly in the wake of tragic incidents in Old Rajender Nagar, Delhi. The Court has expressed sharp criticism of coaching centers as “death chambers” highlighting the gravity of the issue.
The Coaching Federation of India had filed a Special Leave Petition (SLP) before the SC challenging a Delhi High Court order dated December 14, 2023. The Division Bench had directed all the coaching and tuition centres to mandatorily require compliance of fire NOCs and fire safety certificates in terms of the Master Plan for Delhi 2021, read with the safety norms for buildings/ structures prescribed in Delhi.
The Court expressed disbelief that the petitioner sought to challenge a simple order requiring compliance with fire safety norms as per the Master Plan.
“You are playing with the lives of children. For the time being, let coaching be online, and unless you comply with the regulations, fire safety arrangements, etc.”
However, the Bench while dismissing the SLP with exemplary cost issued suo moto notice to the NCT of Delhi and the Union of India to inform the Court of the safety measures and norms they are following and the effective mechanism to ensure their compliance.
