Transgender Persons (Protection of Rights) Act Comes Into Force

The Transgender Persons (Protection of Rights) Act, 2019 has come into force on 10 January 2020. The Act intends to protect persons of transgender identity from discrimination. The Act is made enforceable against all establishments, which covers government and private entities, including all companies, firms, Co-operative societies, trusts etc.

The Act seeks to protect following rights of Transgender community:

  1. Right to equal and fair treatment in educational institutions
  2. Right to equal and fair treatment in availing healthcare services
  3. Right to equal and fair treatment in employment
  4. Right to equal and fair treatment in availing healthcare services
  5. Right to equal and fair treatment in availing goods and services
  6. Right to hold public office
  7. Right to movement and residence
  8. Right to equal and fair treatment in government or private establishment in whose care or custody a transgender person may be

The act directs governments to take measures to enforce these rights and for social inclusion and upliftment of the transgender community. The District Magistrate is empowered to certify a person’s transgender identity and also to grant revised certificate if anyone undergoes surgery to change his/her gender either as a male or a female.

The act also provides penalties for violation of these rights.
