The Government of Tamil Nadu issued a notification on February 14, 2025 regarding draft amendments to the Tamil Nadu Shops and Establishments Rules, 1948. The amendments seek to introduce a new requirement for employers operating in the state.
Key Amendment Highlights:
The draft amendment introduces a new rule—Rule 16-D, which mandates employers to submit an annual return.
Annual Return Requirement:
Employers of establishments will now be required to submit a combined annual return under Section 47-A of the Tamil Nadu Shops and Establishments Act. This return must be furnished through the designated web portal of the Labour Department to the Inspector of the respective area.
Submission Deadline:
The return is to be submitted annually on or before the 31st day of January each year.
New Form Added:
The draft also introduces New Form — Form ZC, which will be used to submit the required details as part of the annual return.
This change aims to streamline the process for employers and ensure compliance with labour laws through digital platforms. It also represents a shift toward more transparent and efficient reporting mechanisms.
Public Consultation:
The draft amendments are open for public scrutiny, and any objections or suggestions from stakeholders are encouraged. The two-month period (April 14, 2025) for submitting feedback will begin from the date of the publication of this notification in the Tamil Nadu Government Gazette.
