The State Government of Madhya Pradesh vide its notification dated 11th January 2021 has issued draft amendments in the Madhya Pradesh Child Labour (Prohibition and Regulation) Rules, 1993 and has invited objections or suggestions from the public which may be addressed to the labour department of Madhya Pradesh .
Key Highlights from the draft amendments:
- Through this amendment a new rule 2A has been inserted which specifies the awareness on prohibition of employment of child and adolescents in contravention to Act in which the state government shall ensure that the children and adolescents are not employed or permitted to work in any occupation.
- As per new rule 2B, a child may, without affecting his school education shall help his family with extra income and the child shall not perform any tasks during the school timings. Further the child shall not be employed in any hazardous occupation or process.
- Rule 2C, which specifies the child to work as an artist, has been inserted, which states that the child can work as an artist and shall not work for more than 5 hours a day. There shall be clean surroundings, physical activity, and proper nutrition for the child. The last 20 percent of the income earned by the child shall directly go into the fixed deposit amount of a nationalised bank to be given to the child after attaining majority.
- Further no adolescent shall be required or permitted to work in an establishment in excess of such number of hours of work as is permissible under the law for the time being in force regulating the hours of work of the adolescent in such establishment.
- Any person may file a complaint under this act for commission of any offence including school teacher and representative from school management, who shall be sensitised to file complaint in the event that any of student in their respective school is employed in contravention to the provision of the Act.
