The Contract Labour (Regulation and Abolition) (Goa Amendment) Bill, 2020 was notified on 10th August 2020.
The Bill contemplates the following changes:
- The Bill seeks to narrow the applicability of the act to establishments or contractors employing fifty or more workmen as contract labour in the last twelve months.
The Bill enhances the requisite number of workers as compared to the Contract Labour Act, 1970. The Act of 1970 prescribes only twenty workers. This enhancement, of the threshold limit of workers, seeks to facilitate initiatives in the field of labour reforms. In particular, the Bill seeks to benefit establishments undertaking small scale operations or those that rely on out-sourced work.
- The Bill incorporates a provision for compounding offences relating to obstruction to the discharge of duties by the inspectors, willful refusal to produce any registers or documents under this Bill or preventing any person from being examined by the inspector. Offences for which no specific penalty is provided under the Bill can also be compounded. The Bill also specifies the amount of composition.
- The Bill also repeals The Contract Labour (Regulation and Abolition) (Goa Amendment) Ordinance, 2020. The Bill once passed shall be deemed to have come into force on the 26th day of June, 2020.
