The Draft Code on Occupation Safety Health & Working Conditions Mizoram Rules, 2023

The Government of Mizoram on 14th March, 2024, notified the Draft of the Labor Code on Occupational Safety, Health & Working Condition (Mizoram) Rules, 2023 to further amend the Draft of the Labor Code on Occupational Safety, Health & Working Condition (Mizoram) Rules, 2023.

The Rules include that a member of the family having income up to Rupees five thousand per month from all sources or any other income notified by the Employees State Insurance Corporation (ESIC) for the purpose of availing medical benefit under the scheme, shall be included as dependent for the purpose of these rules.

Further, The employer of every establishment being factory or relating to contract labor or building or other construction works shall within thirty days of the commencement or cessation of operation or completion of any work submit to the registering officer and in Form-Ill, electronically or otherwise and the notice of cessation of operation shall be enclosed with a certificate that the payment of all dues to the workers employed in the establishment have been made and the premises are kept free from storage of hazardous chemicals and substances. Form-Ill shall be auto shared to Employees Provident Fund Organization and Employees State Insurance Corporation.

If an employee comes to know of any unsafe or unhealthy condition in the establishment, he shall report to the employer, or health and safety representative or safety officer or employer in as soon as practicable, in FORM-X (a). On receipt of information from the employee relating to the existence of an imminent danger to their safety and health, the employer shall take immediate remedial action in this regard. The

employer, whether satisfied or not, shall send a report forthwith of such actions taken in Form X(b) to the Inspector-cum-facilitator electronically or by registered speed post or by telephone within 24 hours of receiving such information.

The Government of Mizoram through a notification has invited Employers’ Organizations and Trade Unions recognized by the State Government to give their suggestions/comments/input, if any, on the revised Rules. Comments may be submitted, latest by 28th April, 2024, by e-mail  to Director, Labour, Employment, Skill Development & Entrepreneurship, Plot No. A/28, Earth Day Road, Near Baptist Church, MINECO, Khatla, Aizawl, Mizoram -796001 or on the official Email address, directorledmz@gmail.com.
