The Governor of Bihar has by an Order specified the date on which section 11 of the Bihar Goods and Services Tax (Second Amendment) Ordinance, 2020 comes into force. The date so declared is 18th May, 2020. This date was specified by an Order dated 7th August, 2020.
It may be recalled that the Bihar Goods and Services Tax (Second Amendment) Ordinance, 2020 was promulgated on 2nd July, 2020.
Section 11 of the Ordinance covers amendments to Section 140 of the Bihar Goods and Services Tax Act, 2017. Section 140 deals with Transitional Arrangements for Input Tax Credit. Prior to the Amendment, Section 140 only prescribed that in order to avail input tax credit; the requisite return must be furnished in the manner provided by the existing law. The amendment now clarified that the return must also be furnished within the time specified by the law. It further reiterated that the return must be furnished in the time and the manner specified by the existing law.
