Revised Custom Duty Exemptions in Excess of Standard Rates

The Ministry of Finance has revised the list of goods that are exempted from custom duties in excess of standard rates . This notification was issued on 29th March, 2023 and shall be effective from 30th March, 2023.

The present notification amends the previous notification dated 30th June, 2017 issued by the Ministry.

The present notification amends the exemption that was previously granted to lifesaving drugs/medicines including their salts and esters and diagnostic test kits specified in List 4. This exemption has been substituted with with Drugs, Medicines or Food for Special Medical Purposes (FSMP) used for treatment of rare diseases.

The notification also extends the exemption to a new category of goods, ‘Drugs, Medicines or Food for Special Medical Purposes (FSMP) used for treatment of rare diseases specified in List 38.’

The terms “drugs or medicines” are substituted with “Drugs, Medicines or Food for Special Medical Purposes (FSMP)”.

The present notification also states that Drugs, Medicines or Food for Special Medical Purposes (FSMP) used for treatment of rare diseases specified in List 38 are subject to the following conditions:

(a) the goods are imported by an individual for personal use;
(b) it is certified in the specified Form, by the Director General or Deputy Director General or Assistant Director General, Health Services, Director of Health Services of the State Government or the District Medical Officer/Civil Surgeon of the district, in each individual case.
