New Updates in Designated Places in Chandigarh 

The Government of Chandigarh, Administrator of the Union Territory of Chandigarh issued a notification stating changes made to a previous notification concerning places for certain legal processes, on 19th July 2024.

The Update includes:

A previous notification issued on June 30, 2024, listed certain places as “Designated Places” for specific legal purposes. The recent modification now removes some of these places from that list. Specifically, Video Conferencing Rooms and Office Rooms that were listed in the following categories are no longer considered DESIGNATED PLACES.

  1. Sr. No. (iii): Video Conferencing Rooms established in all Police Stations, UT, Chandigarh.
  2. Sr. No. (x): Office rooms of DGP, IGP, SSP/UT, SSP/Security &Traffic, SSP/SP Headquarters, SP/ City and all DSPs of Chandigarh Police
  3. Sr. No. (xi): Video Conferencing Rooms at Police Headquarters, Ground Floor, UT, Chandigarh

Affected Legal Sections

The change affects the following sections of the Bharatiya Nagarik Suraksha Sanhita, 2023 (Act 46 of 2023):

  • Proviso to sub-section (3) of Section 265: This section involves specific provisions related to designated places for certain legal processes.
  • Proviso to sub-section (2) of Section 266: This section outlines further provisions for the use of designated places in legal contexts.
  • Section 308: This section includes additional legal processes or protections related to designated places.

Simply put, the legal processes or protections that applied to Video Conferencing Rooms and Office Rooms under these sections of the Bharatiya Nagarik Suraksha Sanhita, 2023, will no longer be applicable. These rooms are no longer recognized as designated places for these specific legal purposes.

This update aims to streamline and possibly reallocate resources or redefine the usage of such spaces within the Union Territory.
