On September 2, 2024, the Department of Forest in Goa announced significant changes to the Goa Preservation of Trees Rules, 1984).  This amendment, marks the Fourth Amendment to the regulations governing tree conservation in the region.

The latest amendment introduces adjustments to the fees and security deposits associated with tree felling and replantation. These changes are aimed at enhancing the effectiveness of tree preservation measures and ensuring better compliance with environmental regulations. The rules are officially known as the Goa Preservation of Trees (Fourth Amendment) Rules, 2024.

 Key Amendments to Rule 6A

The amendment primarily modifies Rule 6A of the Goa, Daman, and Diu Preservation of Trees Rules, 1983. Here’s what has changed:

  • Tree Felling Fee: Initially the Tree Felling Fee was Rs.1000/-. As per the new amendment the fee for felling a tree has been standardized at Rs.400/- per tree. This is a notable adjustment aimed at regulating the cost associated with tree removal, making it consistent and transparent.
  • Security Deposit: Initially the Security deposit for ensuring regeneration of the area and replantation of trees or otherwise was Rs. 1,000/- per tree in case of an individual and Rs. 5,000/- per tree in other cases. As per the new amendment, Security deposit for ensuring regeneration of the area and replantation of trees or otherwise is Rs. 400/- per tree in case of an individual and Rs. 5,000/- per tree in other cases

Implications of the New Rules

The updated rules are designed to:

  • Encourage Compliance: By clearly defining fees and deposits, the rules aim to reduce ambiguity and encourage adherence to tree preservation guidelines.
  • Enhance Regeneration Efforts: The differentiated security deposits are expected to support better regeneration practices, particularly in cases where tree replantation is crucial.
  • Standardize Costs: The new fee structure provides a standardized approach to tree felling costs, which can help in better financial planning and transparency for individuals and organizations involved in tree management.

 How This Affects You

  • Landowners and Developers: If you’re planning any land development or tree management activities, be prepared for the new fee and security deposit requirements. Ensure that your planning includes these costs to avoid any compliance issues.
  • Environmental Groups and Activists: The amendment provides an opportunity to advocate for responsible tree management and to ensure that regeneration efforts are adequately funded.
  • General Public: Awareness of these changes helps in understanding how tree preservation efforts are regulated and can encourage responsible behavior regarding tree conservation.

With these amendments, the Government of Goa is reinforcing its commitment to environmental conservation and sustainable land management. By addressing both the financial aspects and the practicalities of tree felling and replantation, the updated rules seek to strike a balance between development needs and ecological preservation.

Commencement Date: These rules will come into force on September 2nd 2024.
