On July 29th 2024, The Ministry of Consumer Affairs, Food and Public Distribution (MoCAF&PD) has extended the deadline for stakeholders to submit their comments on the Draft Rules for Breath Analyzers.
This extension provides additional time for interested parties to review and offer feedback on the proposed regulations. It underscores the Ministry’s commitment to ensuring that the rules are comprehensive and consider a wide range of perspectives.
The Draft Rules for Breath Analyzers are designed to regulate the use, calibration, and certification of breath analyzer devices. These rules aim to ensure that the devices used for measuring blood alcohol content (BAC) are accurate, reliable, and meet certain standards. Key components of the draft rules include:
- Device Standards: All breath analyzers must comply with specified technical standards. Devices must be capable of providing accurate BAC readings.
- Calibration and Maintenance: Regular calibration of devices is mandatory to maintain accuracy. Detailed maintenance logs must be kept to track the performance and upkeep of the devices.
- Certification and Approval: Only certified and approved devices can be used for BAC testing. Certification must be obtained from authorized bodies as specified in the rules.
- Operator Training: Personnel operating the breath analyzers must undergo proper training. Training programs will be standardized to ensure consistency and competency.
- Data Recording and Privacy: Accurate recording of test results is required. Privacy guidelines must be followed to protect the personal information of individuals tested.
