On October 14, 2024, the Ministry of Commerce and Industry introduced the Explosives (Amendment) Rules 2024, amending the Explosives Rules 2008. These changes aim to enhance safety and streamline processes related to explosives handling and display.
1. Enhanced Definitions
Competent Person
The definition of “Competent Person” now includes recognition by the Controller in addition to the Chief Controller, broadening the scope of qualified individuals in the safe handling of explosives.
New Term: Discharge Site
A new definition for “Discharge Site” has been introduced, referring to the area immediately surrounding fireworks used in outdoor displays. This emphasizes the need for designated safety zones.
Revised Display Fireworks Definition
The term “Display Fireworks” has been revised to clarify that it refers to manufactured fireworks assembled specifically for display purposes, focusing on visible or audible effects.
2. General Restrictions (Rule 10)
Smoking and Fire Safety
The amendments to smoking and fire restrictions near explosives now exempt barcode readers equipped with explosive tracking software developed by the Central Government from the general prohibition on communication devices. This acknowledges the importance of technology in enhancing safety.
3. Record Maintenance and Submission of Returns (Rule 24)
Streamlined Record Keeping
The record-keeping requirements have been updated. Now, individuals, organizations, and companies holding licenses must maintain records in specified formats and make them available for inspection by designated authorities.
Quarterly Returns via Online System
Licensees are now required to submit quarterly returns of explosives through an online tracking system developed by the Central Government. This change aims to improve accountability and simplify reporting.
4. Maximum Consignments Allowed (Rule 51)
Increased Transportation Limits
The maximum limit for transporting Class 2 explosives has been increased to twenty tonnes. Additionally, the design of vehicles used for transport must be approved by the Chief Controller or Controller, ensuring safer transportation of hazardous materials.
