MNRE lists Penalties for Violation of DCR Norms under Solar Projects

The Ministry of New and Renewable Energy (MNRE) has listed penalties for violation of Domestic Content Requirement (DCR) norms under solar PV projects. This notification was issued on 16th October, 2023.

The Indian Government, through a policy of DCR, has been encouraging domestic manufacturers of solar PV cells and modules. This has been undertaken in those instances permitted by the World Trade Organisation (WTO).

However, to prevent misuse of this policy, in respect of those solar PV projects where DCR is mandated in compliance with WTO stipulations, the following actions shall be taken:

  • Filing of criminal case (under section 420 and other relevant sections of the Indian Penal Code, 1860)
  • Black-listing of developer for 10 years
  • Forfeiting relevant bank guarantee
  • Disciplinary action against officers of CPSU/ state government
  • Additional other action

Moreover, it is categorically stated that DCR provisions under respective schemes/ programmes of the MNRE must be strictly complied with. Any violation of these provisions will invite action.
