Manipur Government Issues Labour Laws (Exemption from Renewal of Registration and License by Establishments) Ordinance 

The Government of Manipur, issued a notification dated 29th December, 2023 in which an Ordinance was passed named as Laws Exemption from Renewal of Registration and commencement License by Establishments) Ordinance, 2023. 

The Ordinance shall be covered by the culmination of the following legislation which is termed as ‘Scheduled Act’ in the Ordinance. The Contract Labour (Regulation and Abolition) Act, 1970, The Inter-State Migrant Workmen (Regulation of Employment and Conditions of Service) Act. 1979, and The Building and Other Construction Workers (Regulation of Employment and Conditions of Service) Act, 1996. 

The commencement of this Ordinance, employers do not need to renew the registration or license of an establishment covered by a Scheduled Act. Instead, they need to provide a Self-Certification in the specified form as provided in the Ordinance, within the month of January each year or within 30 days of completing the relevant work, business, or operation.

The commencement of this Ordinance will not impact the following situations:

1.  The previous operation of any provision of any Scheduled Act.

2. The validity, in-validity, effect, or consequence of anything done or suffered under that provision before the relevant period will not be affected.

3. The Ordinance will not affect any right, privilege, obligation, or liability that has already been acquired, accrued, or incurred under any Scheduled Act before the relevant period.

4. Any penalty, forfeiture, or punishment incurred or inflicted in respect of any offense committed under any Scheduled Act before the relevant period will not be affected.

5. Any investigation, legal proceedings, or remedy in relation to any right, privilege, obligation, liability, penalty, forfeiture, or punishment mentioned above will not be affected.

6. Finally, any such investigation, legal proceedings, or remedy in relation to any right, privilege, obligation, liability, penalty, forfeiture, or punishment will be conducted, continued, or concluded according to a Scheduled Act.

The Ordinance also lays down a penalty that if an employer does not provide the Self-Certification required by this Ordinance, they may be fined up to ten thousand rupees upon conviction. However, it is possible to compound this offense under the labor laws applicable in the State of Manipur.

The Ordinance shall apply to the whole of the State of Manipur. It shall be effective immediately. Upon the enactment of this Ordinance, the provisions contained within a Scheduled Act shall be applicable, taking into account the conditions specified in this Ordinance.
