Kerala Mandates New Safety Measures For Security Personnel

On March 10, 2025, the Government of Kerala issued a circular addressing the welfare and safety of security personnel working in shops and other commercial establishments across the state. This directive is aimed at ensuring that security personnel, especially those working outdoors or in open spaces, are provided with essential facilities to safeguard their physical and mental health.

Key Highlights of the Circular:

Amendment to the Kerala Shops and Commercial Establishment Act:

  • The Kerala Shops & Commercial Establishment Act, 1960, has been amended with the introduction of Section 21(b) and the Kerala Shops and Commercial Establishments Act 1961 Rules.

  • The new Section 21B mandates that all establishments provide suitable seating arrangements for workers to avoid them standing on their toes throughout their work shift. This is particularly important for those working in shops and other commercial establishments where the work environment often requires standing for long periods.

Provision of Basic Facilities:

  • Employers are required to provide seating, drinking water, and protection against adverse weather conditions for security personnel working both within establishments and outside in open spaces.

  • Security personnel working in open spaces or in exposed areas should have access to adequate seating facilities and safety equipment to ensure their well-being and comfort.

Protection for Security Staff in Outdoor and Hazardous Environments:

  • Security personnel stationed at establishments along major highways, such as hotels and restaurants operating near state highways, often face challenging work conditions, such as exposure to sunlight and pollution.

  • To address these issues, the circular mandates that employers provide:
    • Reflective coats for visibility during both day and night.
    • Caps, canopies, and goggles to protect against ultraviolet rays.
    • Access to drinking water to ensure hydration.

Safety Standards:

  • Safety equipment and clothing for security personnel should adhere to standards prescribed by the Bureau of Indian Standards, especially when there is a risk of bodily injury or exposure to physical or chemical hazards.

Inspection and Enforcement:

  • The District Labor Officers are instructed to ensure the implementation of these provisions by publicizing the circular through both print and electronic media.

  • Regular inspections should be carried out to ensure that employers comply with these guidelines and provide the necessary facilities.

  • These inspections will also focus on ensuring that security staff are receiving the minimum wages, overtime wages, due leaves, and other occupational benefits. Additionally, it will be checked whether the establishments are registered under the Wage Security Scheme (WPS).

Awareness and Compliance:

  • Assistant Labor Officers and District Labor Officers are responsible for ensuring that security personnel are aware of their rights and the facilities available to them. Employers must verify that the required basic facilities are provided.

Conclusion:

The circular emphasizes the importance of the welfare of security personnel, particularly those working under challenging outdoor conditions. Employers are now legally required to provide the necessary facilities to ensure the safety, health, and comfort of these workers. The government is committed to enforcing these provisions to create a safer and healthier working environment for security personnel in Kerala.

This directive will be closely monitored through inspections and public awareness campaigns, ensuring that all employers are compliant with the new rules.
