On March 10, 2025, the Government of Kerala issued a new circular to enhance the welfare and safety of security personnel working in shops and commercial establishments under the Kerala Shops and Commercial Establishments Act, 1960. The circular addresses several key areas where security staff, particularly those working outdoors, have been facing neglect.
Key Highlights of the Circular:
Seating and Basic Facilities for Security Personnel
- Employers must provide suitable seating and shelter (such as umbrellas) for security staff working outdoors.
- Facilities like drinking water and protection from extreme weather conditions must also be made available.
Safety Equipment for Outdoor Security Staff
- Security personnel working in open areas, particularly in establishments along highways or industrial zones, must be provided with reflective coats, caps, goggles, and canopies for protection against UV rays and environmental hazards.
Compliance with Safety Standards
- Employers must adhere to safety standards outlined under Section 21B of the Kerala Shops and Commercial Establishments Amendment Act, 2018, and Rule 6(4)(a), which requires protective equipment for employees exposed to physical or chemical risks.
Routine Inspections and Compliance Checks
- District Labor Officers will conduct inspections to ensure employers are providing the necessary safety measures and complying with minimum wage, overtime, and occupational benefits for security personnel.
- Special inspections will focus on the security sector, verifying whether establishments are registered under the Wage Security Scheme (WPS).
Public Awareness and Enforcement
- The circular will be publicized through print and electronic media to ensure employers are aware of the new regulations.
- District Labor Officers will ensure compliance and issue necessary instructions to Assistant Labor Officers.
Why This Matters
The new guidelines aim to address the long-standing issue of security staff working in harsh conditions without adequate support. By ensuring access to basic facilities and safety equipment, the Kerala government seeks to improve the health and well-being of these essential workers while ensuring employers meet their legal obligations.
This move is a significant step toward improving the working conditions of security personnel and safeguarding their rights in the state. Employers are urged to comply with the new provisions to create a safer and more supportive work environment.
