The State Government of Gujarat on 3rd October 2019, has published the Gujarat Shops and Establishments (Regulation of Employment and Conditions of Service) Act, 2019. The Gujarat Shops and Establishment Act, 1948, stands repealed.
Key Amendments under the new act
- The Act shall be applicable to all establishments employing 10 or more workers and they shall submit the Application for registration in Form –A to the concerned inspector or submit online application.
- However, establishments with less than 10 workers shall submit an intimation in Form-D of the commencement of the business along with the required documents. All establishments without registration under the Gujarat Shops and Establishment Act, 1948, shall register under this act and such registration shall remain valid till change in ownership or nature of business or revocation.
- The labor department has the power to cancel the registration certificate and remove an establishment from the register of establishments, if such an establishment is found to have obtained its registration through misrepresentation or suppression of material facts, or by submitting forged or false documents.
- Penalties under the New Act have been increased substantially to ensure they are an effective deterrent.
- Further, there are specific provisions relating to women workers, including prohibition of discrimination and overlapping of shifts, the requirement of a crèche facility, latrines and urinals, cleanliness, lighting and ventilation, canteens, Registers, Records and Annual returns and a procedure for informing the closing of business to Inspector in Form- H and I , opening and closing hours of the establishment and Notice of weekly holidays.
