Government Proposes Amendments to Ammonium Nitrate Rules, 2012

The Ministry of Commerce and Industry has published a draft notification proposing amendments to the Ammonium Nitrate Rules, 2012. These amendments aim to streamline the licensing process and reduce regulatory burden for certain categories of businesses.

Key Proposed Changes

  • Definitions: The draft introduces new definitions for “Micro and Small Enterprises (MSEs),” “Micro & Small Startups,” and “Women Entrepreneurs.”
  • Reduced Fees: The draft proposes significantly reduced fees for obtaining licenses and approvals related to ammonium nitrate for businesses categorized as MSEs, Micro & Small Startups, and Women Entrepreneurs.
  • Documentation: The draft specifies the documents required to claim fee relaxation, including certificates from relevant authorities.
  • Combined Benefits: If a business falls under both MSE/Startup and Women Entrepreneur categories, the lowest applicable fee will be charged.
  • False Information: The draft includes a provision for canceling licenses if information submitted by applicants is found to be false or misleading.

Public Consultation:

The public has 30 days from the date the notification is published in the Gazette of India to submit objections or suggestions regarding the proposed amendments. Comments can be sent to the Director (Explosives) through a designated email address or postal mail.

If implemented, these amendments are expected to:

  • Encourage participation of smaller businesses in the ammonium nitrate sector.
  • Reduce compliance costs for eligible entities.
  • Streamline the licensing process.
