Government of Tamil Nadu notifies Draft Industrial Relations (Tamil Nadu ) Rules, 2022.

The State Government of Tamil Nadu vide its notification dated 11th April 2022, has issued the Draft Industrial Relations (Tamil Nadu ) Rules, 2022 which shall extend to the whole of the State of Tamil Nadu.

As per the Draft rule, there shall be an agreement between the employer and worker in Form-I and shall be signed by the parties in the agreement and a copy thereof shall be sent to the Conciliation Officer concerned. Once the agreement is submitted, the employer shall constitute a Works Committee in the manner hereinafter provided:

The number of members constituting the Works Committee shall be so fi xed, as to aff ord representation to the various categories, groups and class of workers engaged in, and to the sections, shops or departments of the establishment:

Provided that the total number of members of the Works Committee shall not exceed twenty: Provided further that the number of representatives of the workers in the Works Committee shall not be less than the number of representatives of the employer therein:

Provided also that there shall be adequate representation for women workers in the Works Committee.

Where workers of an industrial establishment are members of a registered Trade Union, the employer shall ask such Trade Union to inform him in writing as to –

  • how many of the workers are members of such Trade Union; and
  • how their membership is distributed among the sections, shops or departments of the industrial establishment;

The employer may deduct the amount of subscription from the wages of the employee, on the request of the Trade Union, after obtaining their written consent. The amount so deducted shall be construed as an authorised deduction.

On the basis of verification report submitted by verification officer, the employer of the industrial establishment shall grant recognition to Trade Union as a negotiating union or constitute a negotiating council.

If the employer adopts the model Standing Order of the Central Government with respect to matters relevant to his industrial establishment or undertaking, then, he shall intimate the concerned certifying officer electronically the specific date from which the provisions of the model Standing Order which are relevant to his establishment have been adopted.
