Government of Karnataka notifies Karnataka Excise (Bottling of Liquor) (Draft Amendment) Rules, 2022.

The State Government of Karnataka vide its notification dated 7th April 2022, has published the Karnataka Excise (Bottling of Liquor) (Draft Amendment) Rules, 2022 to further amend the Karnataka Excise (Bottling of Liquor) Rules, 1967.

Through this amendment, a new rule 15C which deals with transfer of Bottling Licence in the event of death of the licensee or lessee to legal representative has been inserted as follows:

In the event of death of the licensee or the lessee, during the currency of the licence or lease, the Excise Commissioner may on an application by the legal heir of the deceased licensee or lessee, transfer the Bottling licence or the lease as the case may be in their favour, if such legal heir is eligible for grant of Bottling licence.

Further under rule 15D, the Excise Commissioner may on an application by the licensee and subject to payment of transfer fee equivalent to twenty-five percent of the annual licence fees levied for grant of Bottling licence to Distillery, Brewery, Fortified Winery and Winery, as the case may be, transfer such licence together with all infrastructure pertaining to the industry in favour of any person named by such licensee, if such person is eligible for grant of a licence under the provisions of the Act or the rules made there under.
