Goa Clinical Establishments Ordinance 2024: Key Updates

On October 16, 2024, the Government of Goa announced the Goa Clinical Establishments (Registration and Regulation) (Second Amendment) Ordinance, 2024. This ordinance aims to amend the Goa Clinical Establishments (Registration and Regulation) Act, 2019, with significant changes that affect clinical establishments in the state.

Key Amendments

Extension of Provisional Registration:

A new section, Section 20A, has been introduced, which allows for the revival and extension of provisional registrations. It states:

“Notwithstanding anything contained in this Act or any other law for the time being in force, the provisional registration granted under this Act in the past which has lapsed or which is subsisting shall stand revived or extended and shall be deemed to be valid for a period of one year from the date of coming into force of this section.”

This means that any provisional registrations that may have lapsed will now be valid for an additional year, providing relief to clinical establishments.

Omission of Section 47(3):

The ordinance has omitted Section 47(3), which previously allowed the government to cancel or modify regulations through a notification in the Official Gazette.

Repeal of Previous Ordinance:

The ordinance also repeals the Goa Clinical Establishments (Registration and Regulation) (Amendment) Ordinance, 2024 (Ordinance No. 4 of 2024).

Effective Date

The amendments introduced by this ordinance are set to come into effect on March 15, 2024.
