EMAIL Subscription Terms & Conditions

TERMS OF USE

This terms of use represent the agreement between the individual or entity (having legal personality) represented by the individual subscribing to the services (hereinafter “You” or “Customer”) and Legality Simplified LLP (hereinafter “we” or “us”) governing your subscription to the service of sending publications about legal updates through daily Email provided by us (hereinafter referred to as ‘the service’). E-mail notification of the blogs published shall be sent directly to your inbox on a daily basis.

Acceptance of terms of use

The customer can subscribe to, enjoy, pay for and cancel the services as per these terms of use. The subscription of our services shall imply the acceptance of the following terms of use and they shall be binding on both parties and enforceable through the courts in Chennai. The terms of use shall be valid for the term of the subscription period.

Subscription

The customer can subscribe to the services by choosing a subscription plan and making payment of subscription fees to the account of Legality Simplified. The subscription will be valid for a period based on the chosen subscription plan (‘the Subscription Period). A natural person or a corporate entity who is competent under law to enter into a contract can subscribe to the services.

You must provide your full legal name, a valid email address, and any other required information accurately to complete the sign-up process. You are responsible for ensuring that the email id is valid, and is secure.

If the subscription is availed in the name of a corporate legal entity, the nature of such entity, (Company, LLP, co-operative society etc.) shall be expressly mentioned and payment shall be made from the bank account in the name of the entity.

Renewal

The Subscription period shall not automatically renew. Your subscription will terminate on the expiry of Subscription period.

Upon expiration of the Subscription period, the customer shall renew the subscription by payment of the subscription fee for a chosen subscription plan to the account of Legality Simplified. The services will need to be renewed as per the latest pricing plans available on the website of Legality Simplified.

Communication and Notice

All communication with the Legality Simplified or the customer shall be in writing and carried out through the official email ID of the parties i.e.: For Legality Simplified: admin@legalitysimplified.com

For the Customer: email id used for subscribing to the service

Notices will be deemed effectively given when transmission confirmation is received and sent during receiving normal business hours that is between 9.00 am to 6.30 pm; and on the next day of business day if delivered by email with transmission confirmation and sent after normal business hours.

You shall not send any illegal or inappropriate communications, mails on matters unrelated to services or spam, junk mails or any content infected by any threats like viruses, hacking or worm to the mail id of Legality Simplified.

Amendment and Modifications

These terms may be supplemented, amended, or modified after the end of subscription period but before renewal without any notice. These terms can also be amended during the subscription period with one-month prior notice.

The modification of nature of services means any modifications made to areas of law covered. The nature of services may be supplemented, amended, or modified after the end of subscription period but before renewal without any notice. Payment

We will charge you a standard fee based on your chosen subscription plan. The Service is billed in advance and is non-refundable, except under the circumstances provided in the termination clause.

Cancellation and termination

You alone are responsible for the proper cancellation of your subscription. You may cancel your subscription at any time by sending an email to the official mail id of Legality Simplified. You can cancel at any time, but there shall be no refund for the advance payment made.

If you cancel the subscription by issue of one-week prior notice for any of the following reasons, you shall be eligible for refund of the payment made for the period for which the service is not availed. You shall send the intimation for cancellation when:

No Legal Updates was received from Legality Simplified for four consecutive working days (which shall mean any day on which banks at Chennai are open for transacting normal business) or for seven working days in a month. In order to be eligible for such refund, the notice of cancellation shall be issued within a week of such failure to send updates.
Any modification we make to the nature of services or the terms of use which is detrimental to your interests. If we communicate the revocation of such change to nature of services during the one-week notice period, you shall be ineligible for refund of the payment made for the period for which the service is not availed. In order to be eligible for such refund, the notice of cancellation shall be issued within a week of receipt of prior notification of such change.

Legality Simplified reserves the right to (i) modify or discontinue, temporarily or permanently, the Service (or any part thereof) and to refuse any and all, current and future use of the Service, suspend or terminate your subscription (any part thereof) or use of the Service, for any reason, with a prior notice of one month. You shall receive refund of the payment made for any period for which you are denied the service. However, if Legality Simplified believes that you have violated the Terms of Service, it shall discontinue the services and terminate this Agreement with notice and no refund shall be made.

Copyright

Legality Simplified owns the intellectual property rights to any and all protectable components of the Service, including but not limited to the name of the Service, artwork and end-user interface elements, and the related documentation. You may not copy, modify, adapt, reproduce, distribute, reverse engineer, decompile, or dissemble any aspect of the Service which Legality Simplified owns.

Dispute Resolution

This Agreement is governed by and shall be construed in accordance with the Laws of India without giving effect to any choice or conflict of law provision or rules that would permit the application of the laws of any other jurisdiction. Any dispute relating to the violation of any terms and conditions of the contract or deficiency of services shall be resolved through the courts in Chennai.

Privacy

When you subscribe to our services, we will record your personal information such as your name, email address and mobile number. We use your email address to send you the Legal Updates. We assures that this information will not be made public or sold to any third party. If you contact us to provide feedback, register a complaint, or ask a question, we will record any personal information and other content that you provide in your communication so that we can effectively respond to your communication.

Liability of customer to pay damages

Any misrepresentation of the identity, name, or nature of the entity availing the service, any communication made to the public or the potential clients of legality simplified which is defamatory to Legality Simplified, causing any damage to the website by any act of any user authorized by the customer including but not limited to introduction of any threats like viruses, hacking or worm to the website intentionally or otherwise, misuse of any components of the Service protected under intellectual property laws, including but not limited to the name of the Service, artwork and end-user interface elements, shall give rise to a right to damages and all other remedies available under the law for Legality Simplified.

Indemnity of customer

You shall indemnify Legality Simplified against any loss or third party claims it may incur because of the use of the account by you in any manner contrary to this terms of use.

Liability of Legality Simplified

Any liability that Legality Simplified shall incur against the customer for any cause including breach of any terms of this contract or deficiency of services before any forum shall give rise to right to damages to the customer, in an amount limited to the thrice of the subscription charges paid by the customer, apart from costs. This is customer’s sole remedy and Legality Simplified’s entire obligation and liability for breach under this Agreement.
