Draft Amendment to the Tamil Nadu Motor Vehicles Accident Claims Tribunal Rules

The following draft amendment to the Tamil Nadu Motor Vehicles Accident Claims Tribunal Rules, 1989, which is proposed to be made in exercise of the powers conferred by Section 176 read with Section 211 of the Motor Vehicles Act, 1988 (Central Act 59 of 1988) is hereby published for information of all persons likely to be affected thereby, as required under sub-section (1) of Section 212 of the said Act. 2.

Notice is hereby given that the draft amendment will be taken into consideration on or after the expiry of thirty days from the date of publication of this Notification in the Tamil Nadu Government Gazette and that any objection or suggestion, which may be received from any person with respect thereto before the expiry of the aforesaid period will be considered by the Government of Tamil Nadu.

Objection or suggestion, if any, should be addressed in duplicate to the Additional Chief Secretary to Government, Home Department, Secretariat, Chennai – 600 009.

The Tamil Nadu government has released a draft amendment to Tamil Nadu Motor Vehicles Accident Claims Tribunal Rules, 1989. The amendment has been published in the public gazette dated 10 July,2019 and
invites objections and suggestions which will be taken into consideration by the Government of Tamil Nadu before 10 August ,2019(thirty days from the date of publication of the notification).

According to the draft amendment ;

Rule 26 states that a motor vehicle which is not covered by any insurance policy against third party risks and is involved in an accident which causes damage to property or a body would not be released by the court unless the owner pays the prescribed compensation . The same would be followed in the case when the registered owner fails to furnish a copy of such insurance policy despite demand by the investigating police officer. The motor vehicle procured in the above mentioned scenario is required to be sold off in public auction by the Magistrate having jurisdiction over the area where the accident occurred.

The costs of issue of certificate of test to measure the standard of smoke or
the levels of other pollution or both have been added to the rules. The objections and suggestions are to be addressed in duplicate to the Additional Chief Secretary to Government, Home Department, Secretariat, Chennai – 600 009.
