The Ministry of Environment, Forest and Climate Change has notified amendments to the Battery Waste Management Rules, 2022, seeking to streamline compliance for battery producers. The amendments known as the Battery Waste Management Amendment Rules, 2025 was published on February 24, 2025.
The amendments primarily focus on simplifying the labeling and information dissemination requirements for producers, while maintaining environmental safeguards.
Key Proposed Changes
Exemption for Legal Metrology Packaging
A proviso is added to clause (ia) of paragraph (2) in Schedule I, exempting packaging covered under rule 26 of the Legal Metrology (Packaged Commodities) Rules, 2011, from certain labeling requirements.
Alternative Compliance Through Barcodes and QR Codes
A new clause is introduced, allowing producers to fulfill certain labeling requirements by providing written information to the Central Pollution Control Board (CPCB).
Producers can print a barcode or Quick Response (QR) code containing their Extended Producer Responsibility (EPR) registration number on:
- The battery or battery pack.
- Equipment containing the battery or battery pack.
- Packaging of the battery or battery pack.
- Packaging of the equipment.
- Bulk packaging of batteries or battery packs (not for retail sale).
They can also print the EPR registration number on the product information brochure.
The CPCB will maintain a centralized online portal with a consolidated list of producers opting for this alternative compliance method, updating the list quarterly.
Chemical Symbol Marking Exemption
A proviso is added to clause (v), exempting the marking of chemical symbols ‘Cd’ (Cadmium) or ‘Pb’ (Lead) when the metal concentration in the battery is below specific thresholds:
- Cadmium: less than or equal to 0.002% (20 parts per million) by weight.
- Lead: less than or equal to 0.004% (40 parts per million) by weight.
