The Bihar Municipal (Amendment) Ordinance, 2020

The State Government of Bihar vide its gazette notification dated 12th May 2020 has published the Bihar Municipal (Amendment) Ordinance, 2020 to amend the Bihar Municipal Act, 2007.

The Amendment is brought under section 3 which deals with Constitution of Municipal Areas and Classification of Municipalities in which the state shall after making such inquiry with regard to the population of any urban area, the density of population there in, the revenue generated for the local administration of such area, and such other factors as may be prescribed, by notification, declare its intention to specify such area to be a larger urban area, or a medium urban area, or a transitional area.

Provided further that the total population of main cultivator workers and marginal cultivator workers shall be below fifty percent of the total population of workers in such area in all cases

Further, the quorum necessary for the transaction of business at a meeting of the Municipality shall be 1/3 of the total number of meeting of Councillors.

Under section 145 of the Bihar Municipal Act, No person shall erect, exhibit, fix or retain upon or over any land, building, wall, hoarding, frame post, kiosk, structure, vehicle, neon-sign of sky-sign, any advertisement or display any advertisement to public view in any manner whatsoever (including any advertisement exhibited by means of cinematograph), visible from a public street or public place, in any place within the Municipal area without permission, in writing, of the Chief Municipal Officer.
