The government has clarified that all pharmacies, both online and offline, are required to display current drug price lists as per the Drugs (Prices Control) Order, 2013 (DPCO, 2013). This directive comes in response to concerns about compliance with Para 24 and 25 of the DPCO, which mandates the display of price lists. This office memorandum was issued on February 4, 2025.
Clarification on “Conspicuous Part of Premises”
The government has clarified that the phrase “on a conspicuous part of the premises where he carries on business” in Para 24(4) and 25(3) of the DPCO encompasses both physical and virtual/online/electronic premises. This means that online pharmacies operating through websites, portals, mobile apps, e-commerce platforms, or any other online mode are equally obligated to display the current price list as brick-and-mortar stores.
Obligation to Display Price List
Para 24(3) of the DPCO, 2013, requires manufacturers to issue price lists (Form-V or Form-VI) to dealers, State Drugs Controllers, and the government, indicating any price fixation or revision. Para 24(4) and 25(3) then mandate that every retailer and dealer, including online pharmacies, display these price lists and supplementary lists in a conspicuous and easily accessible manner.
Penalties for Non-Compliance
Failure to comply with Para 24 and 25 of the DPCO, 2013, is punishable under DPCO and the Essential Commodities Act, 1955.
All retailers and dealers, including online pharmacies, are directed to ensure full compliance with the DPCO’s price display requirements. This means both physical pharmacies and online platforms must clearly display the most up-to-date drug price list provided by the manufacturer or marketer.
