The Food Safety and Standards Authority of India (FSSAI) has issued an advisory to all food business operators (FBOs) regarding a Supreme Court order aimed at curbing misleading advertisements. This advisory was issued on November 11, 2024.
Key Points of the Supreme Court Order
Before any advertisement is printed, aired, or displayed, the advertiser or advertising agency must submit a self-declaration on a designated portal, certifying that it does not violate the Advertising Code prescribed under the Cable Television Networks Rules, 1994.
Advertisers must provide proof of this self-declaration to the broadcaster, printer, publisher, or electronic media outlet.
FSSAI’s Guidance to FBOs
FBOs are advised to strictly adhere to the Supreme Court’s directives to avoid legal repercussions.
The Ministry of Information & Broadcasting (MIB) has introduced a new feature on its Broadcast Seva Portal for TV and radio, and the Press Council of India’s portal for print and digital media to facilitate the submission of self-declarations. These online portals have been activate from June 4, 2024.
FBOs should ensure that their advertisements are truthful, accurate, and do not mislead consumers.
