The Central Government has proposed new draft rules to streamline the process of settling outstanding electricity dues. The Electricity (Late Payment Surcharge and Related Matters) (Amendment) Rules, 2024, aim to provide clarity and flexibility in dealing with delayed payments, particularly those arising from court orders.
Key Points of the Draft Amendment Rules
The rules apply to outstanding dues of generating companies, transmission licensees, and electricity trading licensees.
Procedure for dues arising from court orders
For outstanding dues arising from court orders issued after the enforcement of the original rules, the settlement procedure outlined in the court order will be followed.
If the court order doesn’t specify a settlement procedure, the dues will be rescheduled as per the provisions of the original rules.
The reference date for calculating the interest and penalty on outstanding dues will be either the date of the court order or the date of enforcement of the new rules, depending on when the court order was issued.
Distribution licensees are required to communicate the repayment schedule to consumers within 90 days of the reference date.
