New Kerala Factories (Amendment) Rules 2024

The Labour and Skills (B) Department of Kerala on September 28th 2024, notified Kerala Factories (Amendment) Rules 2024 further to amend the Kerala Factories Rules 1957.

Key Features of the Amendment

1. Specific Amendments to the Rules

Modification of Rule 8

One of the primary changes involves a modification to sub-rule (3) of rule 8. The previous reference to Appendix II has been updated to Appendix III.

Initially, as per Kerala Factories Rules 1957 , RULE 8, highlighted TRANSFER OF LICENSE and sub-rule (3) of rule 8 stated, Application for transfer shall be made to the Competent Authority along with the original licence and a treasury chalan receipt evidencing payment of fees for the transfer at the rates prescribed in Appendix II.

As per the new Kerala Factories (Amendment) Rules 2024, sub-rule (3) of rule 8 states Application for transfer shall be made to the Competent Authority along with the original licence and a treasury chalan receipt evidencing payment of fees for the transfer at the rates prescribed in Appendix III

Another important amendment is a new proviso inserted after the substitution of Appendix III, which is :

“Provided that, no fee for transfer of license shall be levied except the amendment fee where a factory is closed and is taken over by another factory due to the reasons of financial crisis, insufficiency of raw materials, non-profitability due to unsold products, shortage of labourers , industrial disputes, or environmental issues duly certified by a competent authority.”
