New Goa Controlled Commodities (Regulation of Distribution) Amendment Order, 2024

The Department of Civil Supplies and Consumer Affairs, Goa on September 5th 2024, issued the Goa Controlled Commodities (Regulation of Distribution) (Amendment) Order 2024 to further amend Goa, Daman and Diu Controlled Commodities (Regulation of Distribution) Order 1956.

Key Changes in the Amendment

  1.  Scope of the Regulation

One of the significant changes is the amendment of Clause 1. Previously, the regulation included the Union Territories of Daman and Diu. The new amendment clarifies that:

  • The regulation now only applies to the State of Goa. The phrase “Daman and Diu” has been omitted, ensuring the law focuses solely on Goa.

This change simplifies the regulatory environment, aligning it with the current administrative boundaries and responsibilities.

  •  Search and Seizure Provisions

The amendment also revises Clause 16 related to search and seizure procedures. The new sub-clause states that:

  • The provisions of Section 103 of the Bharatiya Nagarik Suraksha Sanhita, 2023 regarding search and seizure will now apply to the searches conducted under this regulation.

This modification strengthens the legal framework for enforcement authorities, ensuring that operations involving the distribution of controlled commodities are conducted lawfully and transparently.

  •  Omission of References to Daman and Diu

Lastly, the order mandates the omission of all instances where “Daman and Diu” appear in the principal Order. This ensures consistency throughout the regulatory text and reaffirms the focus on Goa.
