New Changes Proposed to India’s Air Pollution Rules: What You Need to Know

On July 19, 2024, the Ministry of Environment, Forest and Climate Change (MoEF&CC) released a draft of new changes to the Air (Prevention and Control of Pollution) Rules, 1982. These changes are aimed at making the rules stricter and more effective in fighting air pollution.

Key Additions

  1. New Roles Defined:
    • Adjudicating Officer: This is a new position created to handle cases related to air pollution. These officers will be appointed under a specific section of the Act.
    • Presenting Officer: These are officials (or their authorized representatives) who will look into instances of non-compliance with the air pollution laws. They will also present these cases to the Adjudicating Officers.
  2. New Chapter and Rules:
    • Chapter 8:
      • Rule 18: Focuses on how Adjudicating Officers will be appointed.

Importance:

These amendments are a step towards better enforcement of air pollution control laws. By defining new roles and responsibilities, the government aims to ensure that violations are promptly addressed and that there is a clear process for handling non-compliance.
