The Finance Department of Rajasthan on July 10 , 2024, issued the Rajasthan Registration (Amendment) Rules, 2024 to further amend the Rajasthan Registration Rules, 1955.
As per Rule 181 of the Rajasthan Registration Rules, 1955(Volume -I)
When a court cancels a registered document under Section 39 of the Specific Relief Act, 1877, they send a copy of the decree to the registering office where it was registered. The registering officer then notes this cancellation in red ink on the document’s copy. They also record details like the court’s name, decree number, and date in the office’s index. This helps keep the registers accurate and reliable. The note of cancellation is signed by the registering officer on duty.
Section 39 of the Specific Relief Act empowers the court to do so when the instrument has been:
- Fraudulently or improperly obtained, or
- Adversely affected by mistake, or
- Rendered invalid in some way.
As per the new rules – Rajasthan Registration (Amendment) Rules 2024
Rule 181 says that, when a court or authority orders the cancellation or correction of a registered document, they send a copy of the order to the registering office where it was originally registered. The registering officer then makes a note on the document itself, stating who issued the order, the date, and details of the parties involved. They also update their records to reflect these changes in the registration index.
The rules will come into force from 10thJuly 2024.
