The Government of Gujarat on July 1, 2024, issued the Gujarat Laws (Amendment Of Provisions) Ordinance, 2024 to further amend the provisions of the Acts made by the State Of Gujarat to give effect to the references to the Bharatiya Nyaya Sanhita (BNS), 2023, the Bharatiya Nagarik Suraksha Sanhita (BNSS), 2023 and the Bharatiya Sakshya Adhiniyam (BSA), 2023 in place of reference to the Indian Penal Code, 1860, the Code of Criminal Procedure, 1973 and the Evidence Act, 1872 respectively in the said Acts.
The Ordinance lists down the Gujarat Acts and Rules that have been amended in accordance to the BNS, 2023, the BNSS, 2023 and the BSA, 2023.
Amendments to the Gujarat Fire Prevention and Life Safety Measures Act, 2013
In section 42, for the words “under section 176 of the Indian Penal Code 1860”, the words “under section 211 of the Bharatiya Nyaya Sanhita, 2023 (45 of 2023)” shall be substituted and In section 46, in sub-section (1), for the words “within the meaning of section 21 of the Indian Penal Code”, the words “within the meaning of section 2 (28) of the Bharatiya Nyaya Sanhita, 2023 (45 of 2023)” shall be substituted.
Amendments to the Gujarat Electricity Industry (Reorganisation and Regulation) Act, 2003
In section 18, in sub-section (5), for the words “The provisions of the Code of Criminal Procedure, 1973 (2 of 1974)”, the words “The provisions of the Bharatiya Nagarik Suraksha Sanhita, 2023 (46 of 2023)” shall be substituted.
Similarly, amendments are proposed to other Gujarat laws replacing references to the Indian Penal Code, Code of Criminal Procedure and Evidence Act that are specified under the Schedule of the Ordinance.
The newly re-enacted Acts shall come into force with effect from July 01, 2024.
