Mandatory Paid Holiday for Workers in West Bengal

In preparation for the upcoming bye elections to the West Bengal Legislative Assembly from constituencies 35—Raiganji, 90—Ranaghat Dakshin (SC), 94—Bagda (SC), and 167—Maniktala on July 10, 2024, the Government of West Bengal has mandated a crucial provision under the Representation of Peoples Act, 1951. This provision requires employers across industries, including businesses, trades, and shops, to grant a paid holiday to their employees on the polling day. This notification was published on June 19, 2024.

The directive extends to all workers, including those on a shift basis and casual workers, ensuring that every eligible voter can participate in the electoral process without hindrance. Failure to comply with this requirement may result in penalties for employers. Moreover, the provision also covers voters who, despite residing in one constituency, work in another, underscoring the universal applicability of this electoral privilege. This measure aims to uphold democratic principles by facilitating maximum voter turnout and enabling employees to exercise their right to vote effectively.
