Paid Holiday Entitlement for Employees During General Elections in Daman 

The notification issued on 28th March, 2024, by the Office of the Chief Electoral Officer, Secretariat, Daman, pertains to the General Elections to the Lok Sabha -2024 for the Palghar Parliamentary Constituency of Maharashtra State, scheduled for 20 May, 2024. 

It emphasizes the provisions of section 135B of the Representation of People Act, 1951, which mandates the grant of paid holidays to employees on the day of the poll. The scope of this provision extends to electors who are employees of Government Offices, Semi-Government Offices, Local Bodies, Public Sector Establishments, and Shops, including those working on a shift basis. 

Additionally, it clarifies that individuals ordinarily residing in the constituency and registered as electors, but serving or employed in industrial undertakings or establishments outside the constituency, are also entitled to the benefit of a paid holiday.

Furthermore, the notification underscores that daily wage/casual workers are entitled to a holiday and wages on the poll day. It directs all employers of commercial establishments, businesses, trades, industrial undertakings, and other establishments to comply with the provisions of section 135B of the Representation of People Act, 1951. Non-compliance with these provisions renders employers punishable as per the stipulations of the Representation of the People Act, 1951.
