Goa Government amends Goa Land Development and Building Construction Regulations, 2010

The Department of Town and Country Planning, Government of Goa proposed to amend existing Goa Land Development and Building Construction Regulations, 2010, vide Notification No. 21/1/TCP (A)/ /2018/Steering Committee/2398 dated December 26, 2018 and invited objections and suggestions for proposed amendments.

Subsequently, considering all the objections and suggestions received the Steering Committee set up by the Government of Goa, submitted the report along with recommendations to government. The Government  has amended the Regulation as follows:

  1. The amended regulation will be known as Goa Land Development and Building Construction (Amendment) Regulations, 2019.
  2. Regulation 2 (90) has been amended to provide a new and improved definition for the term ‘Notary Architect or Notary Engineer’ who will act as a third party certifier for low risk buildings and related activities.
  3. Regulation 3.1 has been amended to provide exemption from the permission of the Competent Authority. No permission is required by Competent Authority for setting up solar farm and its construction upto a limit of 2% of the total area of farm and maximum of 200 sq.mts. per MW.
  4. A new Regulation 3.5C has been inserted empowering Government to develop online or offline modes of obtaining permission related to Technical Clearance, Construction license, Completion order and occupancy certificate.
  5. Through amendment in Regulation 4.2 (g) the limit of three storey residential building in a plot not exceeding 500m2 and 20 mts. Depth is eliminated.
  6. Newly inserted Regulation 5A provides for the definition of ‘Shopping mall cum Multiplex’ its site requirement, Location and Height criteria  and Parking.
  7. Amendment in Sub-Regulation 20.1 has exempted Structural Engineers, Engineers and other professionals employed with Government Departments and undertakings to obtain registration from Registering Authority subject to the condition that they possess all relevant qualifications as per these Regulations.
  8. The amendment has also substitutes Annexure I, X  and XIA .
