The Government of Goa on 16th February, 2024 introduced the Goa Land Use (Regulation) (Amendment) Bill, 2024. This Bill is aimed at amending the Goa Land Use (Regulation) Act, 1991.
Notably, the amended section specifies instances where the Act shall not apply, including the acquisition of land vested in a tenant under the Goa Agricultural Tenancy Act, 1964, by the State for public purposes under the Land Acquisition Act, 1894, and the Right to Fair Compensation and Transparency in Land Acquisition, Rehabilitation and Resettlement Act, 2013.
Driven by the enactment of the Right to Fair Compensation and Transparency in Land Acquisition, Rehabilitation and Resettlement Act, 2013, the Bill aligns with contemporary land acquisition frameworks and policies. It aims to streamline the utilization of land vested in tenants for community or public projects by local authorities such as Village Panchayats, Municipal Councils, and Municipal Corporations. Additionally, the Bill advocates for the utilization of such land by educational institutions with prior approval from the Government, fostering sustainable development and enhancing public infrastructure.
The Statement of Objects and Reasons accompanying the Bill elucidates its intent to incorporate provisions from the Central Act and policies on land procurement framed by the Government. By facilitating the establishment of projects for community and public welfare, the Bill underscores its commitment to balanced land use practices that cater to the evolving needs of the region. The bill also includes a financial memorandum stating no financial implications and no delegated legislation.
