MoEFCC Introduces Environmental Protection Amendment for Brick Kilns

The Ministry of Environment, Forest and Climate Change (MoEFCC) has introduced the Environment (Protection) Sixth Amendment Rules, 2023. The rules bring forth key amendments to the Environment (Protection) Rules, 1986, specifically addressing the regulation of brick kilns. These amendment rules were published on December 15, 2023 and have come into immediate effect.

Key Amendments:

1. Amendment to Schedule-I:

  • The amendment mandates the conversion of existing brick kilns to zig-zag technology or vertical shaft or the use of piped natural gas as fuel in brick making.

2. Conversion Deadline for Brick Kilns:

  • Existing brick kilns that are not following zig-zag technology or vertical shaft or using piped natural gas as fuel must undergo conversion within specific timelines.
  • Kilns located within ten kilometers of non-attainment cities, excluding million-plus population cities, NCR districts, and critically & severely polluted areas categorized by CPCB, must comply before 23.02.2024.
  • Other kilns have a deadline of 23.02.2025 for compliance.

3. Stringency and Compliance:

It is emphasized that where Commission for Air Quality Management, Central Pollution Control Board, State Pollution Control Board, or Pollution Control Committee has issued more stringent norms or timelines, such orders shall prevail.

The introduction of zig-zag technology, vertical shafts, or the use of piped natural gas is expected to contribute to reduced air pollution and improved air quality in the specified regions. Stakeholders in the brick-making industry are urged to adhere to the stipulated timelines for conversion.
