The Bihar Urban Planning and Development (Amendment) Act, 2022.

The State Government of Bihar on 2nd April 2022 has published the Bihar Urban Planning and Development (Amendment) Act, 2022 to further amend the Bihar Urban Planning and Development Act 2012.

Through this amendment, the application under section 47 for area development scheme has been substituted as follows:

The eligible developers shall in the prescribed form make an application before the Planning Authority for approval of the Area Development Scheme(s) and the applications shall be accompanied by the following documents—

(a) detailed project report of the Area Development Scheme comprising details as mentioned in the section-48

(b) consent of 80 percent of land owners and 80 of the total plot area in form of registered title documents or registered power of attorney or registered development agreement in the favour of developer;

Provided that in the Scheme to be executed by any Planning Authority, consent of 80 percent land owners of the total number of landowners or consent of land owner of 80 percent of total plot area shall not be required.”
