The State Government of Kerala on 15th December 2021 has notified the Kerala Social Security (Draft) Rules ,2021 and has invited Objections and suggestions from the public which shall be addressed to the Secretary to Government, Labour and Skills (D) Department, Government Secretariat, Thiruvananthapuram – 695 001 within forty five days.
The rules provides the constitution, duties, procedure for functioning and role of members of Kerala Unorganized Workers Social Security Board. and Kerala Building and other Construction Workers Welfare Board.
The Rules also provides the procedure for providing maternity benefit and gratuity and collecting cess in respect of building and other construction workers. It also provide remedy for denial of gratuity and maternity benefit. Gratuity shall now be paid in demand draft or directly deposited to bank account.
Further as per the rule, any employer who has received information of an accident may at any time, notwithstanding the fact that no claim for compensation has been instituted in respect of such accident, present to the Competent Authority a memorandum, supported by an affidavit made by himself or by any person subordinate to him having knowledge of the facts stated in the memorandum, embodying the results of any investigation or inquiry which has been made into the circumstances or cause of the accident.
