Madhya Pradesh Electricity Regulatory Commission (Terms and Conditions for Intra-State Open Access in Madhya Pradesh) Regulations, (Revision-I) 2021 (Fourth Amendment) 2024

The Madhya Pradesh Electricity Regulatory Commission issued a notification on 13th March, 2024, for introducing the Fourth Amendment to the Madhya Pradesh Electricity Regulatory Commission (Terms and Conditions for Intra-State Open Access in Madhya Pradesh) Regulations, 2021. These amendments are set to come into force upon their publication in the Madhya Pradesh Gazette.

The first amendment introduces additional surcharges for open access consumers who exceed their contract demand with the Distribution Licensee, while exempting those who avail power within their contract demand and pay fixed charges. The second amendment specifically addresses green energy open access consumers, outlining provisions for the application of additional surcharges based on their power usage compared to their contract demand with the Distribution Licensee. 

It specifies the conditions under which additional surcharges will be applied to open access consumers, particularly those exceeding their contract demand with the Distribution Licensee. Furthermore, it distinguishes between regular open access consumers and green energy open access consumers, providing separate provisions for the latter. The amendments aim to regulate and manage the utilization of open access electricity within the state, ensuring that consumers adhere to their contract demands and pay fixed charges to the Distribution Licensee to avoid incurring additional surcharges.

The Madhya Pradesh Electricity Regulatory Commission in regards to the amendment issued a public notice inviting suggestions/ objections / comments on the above draft Regulation which can be submitted by 12th April, 2024 on the official address mentioned in the public notice. The Commission shall hold a public hearing on 16th April, 2024 at 11:00 AM through video conferencing. The persons who have filed their suggestions/objections/comments in writing with the Commission within stipulated period may intimate their mobile number and e-mail ID to participate in public hearing as per the relevant guidelines available on the Commission’s website.
