The Governor of Himachal Pradesh vide ordinance published on 9 July, 2020, has amended the Factories Act as applicable to Himachal Pradesh. The amendment provides for compounding of offences under the act by first time offenders.
The offense can be compounded by the Chief Inspector, either before or after the institution of the prosecution, on realization of such amount of composition fee as he thinks fit, but not exceeding the maximum amount of fine fixed for the offence. The compounding shields the offenders from any further prosecutions as strongly as a double jeopardy claim.
