FSSAI Directs states to Make Strict Implementation of RDA Norms

Food Safety and Standard Authority of India vide its notification dated 11th June 2020 directed the food safety commissioners of all the States to ensure that the companies are selling products such as health supplements and nutraceuticals after ensuring they comply with Recommended Dietary Allowance (RDA) norms.

As per section 22 of FSS Act, 2006 and the FSS (Food for Health Supplements, Nutraceuticals, Food for Special Dietary Use, Food for Special Medical Purpose, Functional Foods and Novel Foods) Regulation, 2016 the quantity of the nutrients added to the food shall not exceed the Recommended Daily Allowance (RDA) prescribed by Indian Council of Medical Research.

The order comes after the food safety authority received complaints regarding the issue of licenses for food products as per FSS Regulation, 2016 by the licensing authority without duly scrutinizing the RDA values and certain products with nutrient quantities exceeding the RDA values are being sold in the market under the FSSAI license.

FSSAI in the latest order directed all the central and state licensing authorities to strictly implement the limitation of ‘Not more than one RDA’ for nutrients as per Section 22 of FSS Act, 2006 except for Food for Special Medical Purposes and Food for Special Dietary Uses, where the use of more than one RDA is permitted. It has also ordered them to review whether companies with existing licenses are adhering to these norms and to issue notices to such manufacturers to direct them to undertake necessary modifications in compliance with the FSSA Act, 2006.

As per the order, stringent action will be taken against the defaulters of the above-said regulation.
