The Court reiterated the “Bolam Test,” which states that a medical professional cannot be held liable for negligence if they acted in accordance with a practice accepted as proper by a responsible body of medical opinion. The Court clarified that the burden of proof lies with the patient to establish negligence on the part of the doctor.

The Court held that state governments have the primary authority to legislate on intoxicating liquor, including industrial alcohol, under Entry 8 of the State List. Through its majority judgment, the Court overturned the 1990 judgment that had granted the Centre greater regulatory power over industrial alcohol.
