The petition was filed by the All India Private Educational Institutions Association challenging the order dated November 26, 2010 which provided for application of Employees State Insurance Act to both aided and unaided educational institutions.

The plea moved by the All India Private Educational Institutions Association alleged that the government had “discriminated” between government-aided and private unaided educational institutions. The issue was referred to the bench because conflicting Judgments was entered in the past by the High Court in the matter.
