Employee’s Provident Fund and Miscellaneous Provisions (Amendment) Bill, 2019

The Ministry of Labour and Employment in its notification dated 23rd August 2019 has proposed to amend the Employees’ Provident Funds & Miscellaneous Provisions Act, 1952. The Bill has been issued as part of the Government’s pre-legislative consultative process and comments and inputs from stakeholders and public have been invited which can be submitted by September 15th, 2019. Among important changes, government proposes to change the definition of wages under the act to align it with the recently notified wage code.

PESO mandates licensing for Ethanol transport

Inspection of Establishments based on SC Judgment on basic wages cannot be done

The Employees Provident Fund Organisation vide notification dated 28.08.2019 has issued a clarification to establishment with respect to inspection of records to ascertain whether any allowances which are part of basic wages have been omitted.
Following the judgement of Supreme Court, several field offices have issued notice to employers proposing inspection of records for past 3-5 years. Since, the review petition is pending in Supreme Court, such inspection cannot be done unless prior permission from Central Analysis Intelligence Unit (CAIU) is taken.
